Ebay seller may not give a refund, Unfair sale?

So i bought a sewing machine from this Sabbashop here

it’s my fault i didn’t read the description in detail. The description said it was NEW, and INCLUDES: SEWING MACHINE, ACCESSORIES, INSTRUCTIONS . So i thought it was totally brand new and nothing was missing and there was warranty (since there is a manual, i thought its like store bought u know? ) BUT when i received it… THEY GAVE ME JUST THE MACHINE, NO ACCESSORIES (the accessory case was removed), NO MANUAL JUST THE MACHINE!!! So i emailed them back, i was like "hey I can’t sew the machine without the the table and the case, if you guys have it i want it sent to me, if not maybe you guys can help me get it using the warranty, if nothing works i want a refund" So they reply saying if i revise the negative feedback (i gave it to them cause so much stuff was missing) we’ll refund you 30 bucks (total is [63 CAD of machine] +[ 28 for shipping]) After some thinking i thought its a REALLY bad idea to keep this machine…i mean the accessories are hard to find and might be expensive n NO WARRANTY. So i spam them no i want a refund and decline their offer. Now i waited a few days, spamming them for refund (i have to notify them if i want a refund),,,i didnt get any replies still. I’m worried they are trying to steal my money . What should i do. I think i got the upper hand b/c the post DID lie "PRODUCT CONDITION: THIS IS A NEW ITEM IN ORIGINAL PACKAGE, WHICH MAY HAVE BEEN OPENED TO INSPECT. FULLY FUNCTIONAL & COMPLETE

SabbaShop liquidates new , used, overstock, open-box, returns, shelf-pulls or store display items. Some items may be new in box, however SabbaShop is in no way affiliated with the manufacturer. The item does not carry any manufacturer warranty, even if sold as new.

So any pro ebayers out there, please help me out. Whats the best way to get my money back? I heard something about the buyer protection but i’m a bit vague on that.

Yes, he is at fault 100%.

I know he is at fault, but you should have contacted the seller before leaving the neg. feedback. Sellers will usually work with you to get the issue resolved quick to avoid any negatives.

There are so many errors in that listing that I am surprised a seller w/over 100,000 feedback screwed up this bad.

1. He listed it as ‘NEW’ & not NEW (See Description Below). Items listed as NEW must include all accessories that were included in the package. Therefore, he didn’t follow Ebay condition guidelines. Big Strike.

2. This is not a ‘AS IS’ listing and you are entitled to return the item for a full refund with in the 30 days of purchase.

3. Even in his own description, it says accessories are included. Another Ebay condition violation.

So here’s what you want to do.

Give him one last chance to make it right.

Send him one last message (one to his email that you get from paypal & the other using Ebay messages) letting him know, that you want to return the item for a full refund. In the message make sure you tell him that the item you received was not the item described in the ad. List all the reasons. Make him pay for the return shipping cost (if you want). This was HIS fault and not yours. This will make him think twice before making the same mistake. And mention if you don’t hear from him or if he refuses to make things right, that you will file a paypal claim.

Most sellers will cave in as soon as they see the words "paypal claim" and do anything the buyer says. They won’t steal your money because they are an established top rated seller w/over 100,000 feedback so the account is not worth losing over 100.00. Plus, your protected with Ebay’s buyer protection program so you’ll receive your money regardless.

So if for any reason, the seller just does not want to cooperate. THEN,

Go to Paypal. file a "ITEMS NOT AS DESCRIBED" Claim, put all your reasons, a link to the ad, & make it clear that what you received was not what you ordered. I doubt he’ll try to fight it, but he might because of the negative feedback you left him, even if he does. He will lose for sure. He will only fight, so that you have to wait a lot longer to get your refund. (That’s why its best to work with sellers before leaving the negatives, otherwise, they’ll go out of their way to be dicks)

You’ll then have to return the item w/tracking & once Paypal confirms the delivery, you will get a full refund.
